Acceptable Use Policy
This Acceptable Use Policy (AUP) sets out the rules for using Mainder. By accessing the platform, every user accepts these rules. Violations may result in immediate suspension or termination of access, in addition to any legal liability.
1. Permitted use
Mainder may only be used for lawful purposes related to talent acquisition, recruitment process management and professional sourcing. Specifically, users are authorised to manage selection processes, evaluate candidates against role requirements, contact candidates within a professional context, and collaborate with their team on hiring decisions.
2. Prohibited uses
Users may not use Mainder, directly or indirectly, for any of the following:
- Discriminatory practices based on race, ethnicity, gender, age, religion, sexual orientation, disability, pregnancy, marital status, political opinion or any other protected characteristic under applicable equal-opportunity legislation.
- Purposes unrelated to recruitment, including mass marketing, commercial scraping, prospecting for sales, or building third-party databases.
- Sharing, selling or transferring candidate data to third parties not explicitly authorised by the Controller and the candidate (where consent is required).
- Reverse engineering, decompiling, scraping, automated harvesting, denial-of-service, vulnerability scanning without prior written authorisation, or any other attack on the service or its infrastructure.
- Spam, harassment, threats, intimidation or contact with candidates outside a legitimate professional context, including unsolicited communications unrelated to a real opening.
- Any use that violates applicable law, infringes intellectual property rights of third parties, or facilitates fraud, impersonation or identity theft.
- Uploading or processing through the platform special categories of personal data (Art. 9 GDPR: health, racial/ethnic origin, political opinions, religious beliefs, trade-union membership, genetic, biometric, sex life, sexual orientation) without an explicit legal basis and the safeguards required by law.
3. Fair use of AI
Mainder's AI systems produce recommendations and rankings to assist recruiters. They do not make automated decisions with legal or similarly significant effects without human intervention. Users must (i) treat AI output as decision support, not as a final verdict, (ii) maintain meaningful human review for hiring decisions in line with Art. 22 GDPR, and (iii) not attempt to circumvent the controls that prevent the inference of emotions, biometric categorisation or processing of Art. 9 GDPR special categories.
4. Consequences of violation
Mainder may, at its sole discretion and without prior notice when necessary to protect the service or third parties, (i) suspend or terminate the user's access, (ii) remove unlawful content, (iii) notify the Controller, (iv) cooperate with competent authorities and (v) pursue applicable legal remedies. Suspension or termination does not entitle the user to a refund of paid subscription fees for the current period.
5. Reporting
To report misuse, abuse or any violation of this policy, contact abuse@mainder.ai. Reports are treated confidentially within the limits of applicable law.
6. Changes to this policy
Mainder may update this policy as the product evolves or as required by law. Material changes will be reflected in the last updated date above and, where applicable, communicated through the platform with reasonable notice.
